Earlier this week, the Village attorneys filed a Motion to Dismiss the lawsuit filed by Haymarket DuPage LLC in December. In the lawsuit, Haymarket argues that it should have been originally allowed to seek a special use permit to operate as a health care facility in Itasca.
Today, the Village attorneys appeared in DuPage County Court for presentation of the Village’s motion. A briefing schedule for the motion and hearing date was set by the Court. The Motion to Dismiss is scheduled to be heard by the Honorable Judge Bonnie M. Wheaton on March 16, 2020 at 9:30 a.m.
